The products sold by Shop Poggetto Carni are cured meat products which, by their nature, fall into the category of "goods that are liable to deteriorate or expire rapidly" pursuant to art. 59, paragraph 1, letter d) of the Consumer Code (Legislative Decree 206/2005). For such goods, the 14-day right of withdrawal provided for by articles 52 et seq. of the Consumer Code does not apply.
The exclusion also applies to vacuum-packed products: once shipped, the breaking of the cold chain and the impossibility of guaranteeing proper storage conditions during the return transport make the product no longer suitable for sale, for the protection of the health of the final consumer.
The exclusion also applies, pursuant to art. 59, paragraph 1, letter e) of the Consumer Code, to sealed products that have been opened after delivery, for hygiene and health protection reasons.
By making a purchase, the Customer acknowledges and accepts that the purchased products fall within the categories indicated above and that, therefore, the right of withdrawal may not be exercised once shipment has taken place.
The Customer's rights in the event of defects of conformity, damage during transport, or products not matching the order remain unaffected, for which reference is made to the following paragraph "Warranty and Defects of Conformity" and to the paragraph "Complaints".
A Customer who wishes to cancel the order before it has been shipped may do so by writing to shop@poggettocarni.com or by using the self-service cancellation function available on the website. In the event that the cancellation is accepted, the refund will be made within 14 days from the notification, using the same payment method employed.
In the limited cases in which Shop Poggetto Carni, at its discretion, accepts a return even where the exclusion cases set out in Section 1 apply, the following terms shall apply.
The Customer who intends to exercise the right of withdrawal must send an email to shop@poggettocarni.com listing the reasons for which they intend to make use of the right of withdrawal.
In the event of exercise of the right of withdrawal, Shop Poggetto Carni will refund the customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the withdrawal notice was received, without prejudice to Shop Poggetto Carni's right to suspend payment of the refund until the goods are actually received. The refund will be made using the same payment method used by the Customer, unless the Customer has expressly requested a different method. In the event of bank transfer or cash on delivery payment, it shall be the Customer's responsibility to provide the bank details to which the refund is to be made (account holder, bank name and address, and IBAN).
Also in order to ensure that the return is free of charge, the products must be returned in the same box in which they were received.
The right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:
With reference to the exclusion cases of withdrawal listed above, the Customer, in particular, is informed of and accepts Products that "are liable to deteriorate or expire rapidly".
Therefore, for hygiene reasons and to protect Customers, the right of withdrawal applies only to Products purchased on the Site that can be returned to Shop Poggetto Carni and put back on the market without any risk to consumer health. In cases where the right of withdrawal is excluded, Shop Poggetto Carni will destroy perishable products mistakenly returned by the customer in compliance with health and hygiene regulations, as the company cannot guarantee the hygiene and sanitary conformity of the returned products.
In the event of defects of conformity in Products sold by Shop Poggetto Carni, the Customer must immediately contact Customer Service by sending an email to shop@poggettocarni.com. The sale of the Products is subject to the legal warranties provided for by articles 129, 130 and 132 of the Consumer Code.
The Customer is entitled, at their choice and provided that the type of Product allows it, to have the Product conformity restored free of charge by repair or replacement, or to an appropriate price reduction or contract termination. The Customer loses these rights if they do not report the defect of conformity to Shop Poggetto Carni within 1 month from the date on which they discovered the defect, provided that the Product is not one which by its nature is perishable or subject to expiry within a shorter period, in which case the defect must be reported within that shorter period.
The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which Shop Poggetto Carni cannot therefore be held responsible, except in cases of wilful misconduct or gross negligence.
Shop Poggetto Carni reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted, or to modify or update the information at any time without prior notice, without prejudice to the Customer's rights under these General Terms and the Consumer Code. Except in cases of wilful misconduct or gross negligence, any right of the Customer to compensation for damages or to acknowledgment of indemnity is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or property, caused by the failure to accept or fulfill, even partially, an order.
